I worked over 40 hours and I live in PA. Working as a bartender 8-12 hour shifts with no breaks at all or overtime pay. Is all that legal?

Because back in 2003 Me and another coworker were overwhelmed in our department and would skip lunches so we could get the job done. It was a Federally funded Company so we assumed they knew the law. Well they wrote us up for not taking any lunches. Also with the job I am at now I get paid every two weeks. I work 42.50 one week and 34 the next week. Is it because it is under 80 I do not get paid over time or is it most definitely 40. If it is 40 what is the pay rate? Thanks again Betty3 03-15-2009, 01:45 AM Maybe where you worked before your employer allowed/required breaks but there is no law that requires employers to offer them in Pa except to minors under 18. or - Maybe where you worked before because it was a federally funded co. there was something in a "contract" re breaks. You need to get paid overtime for every workweek in which you work over 40 hrs. Each workweek stands alone. You must be pd. 1 1/2 times the regular rate of pay for all hours worked in excess of 40 in a workweek. If you are due OT, you can put in a claim with your state's DOL.
