Hello,
I have been researching Illinois laws in regards to the current occupant failing to make a payment for 2 months(Feb and March). Our original written lease with option to own expired on 9/1/2008(he asked for a verbal 6 month extension, and like an idiot, I agreed). There has been a million excuses as to why he hasn't commited(which tells me he wants to back out, but since I cant get ahold of him in any way to find out for sure).
I am in the process of creating a paper trail: cover letter explaining what I am expecting and by when, notice to pay or vacate, etc. The main things I am concerned with, is that I want him to sign some form of paper to either commit to buying the house or just pay me what is owed and leave. I dont have the money to have a lawyer constantly drafting papers. Is anything I write up on my own considered legal and binding, should it go to court? I'm worried that any form I may find on the internet could turn around to bite me. Has anyone went this route and had success?
Also, if I send a letter wanting to inspect the outside to see how badly it wasn't maintained(since he cant be reached by phone), is setting an advanced date/time of 2 weeks considered legal, even if he doesnt contact me to say yes or no?
