View Full Version : Dad is filing bankruptcy...what happens to child support Florida

We just completed a two year long modification for child support in October 2008. He filed then that he paid for health insurance, however now he states that he dropped the child a year ago from his insurance. He quit his job and claims to have started filing bankruptcy and has turned around and refiled for modification again in March. What recourse do I have against modification, can I be awarded attorneys fees and how do we prevent it from happening again? If I am awarded anything and he files bankruptcy I am out attorneys fees again, how is this possible?

Since a modification was recently done, he'll have to prove a substancial change in circumstances for this modification. If he quit his job that is voluntary unemployment, which can be one of your defenses.

If you win in court, you can ask for legal fees to be ordered.
