I have a question reguarding overtime pay. I have read the Colorado Division of Labor Rules and Regs reguarding overtime and have shared them with my employer and have gotten nowwhere with them. After a shift I am required by my employer to work from home and additional 8 to 10 hours. My employer will only pay us for 1/2 half of the time worked at home. It is paid as overtime but only for half of the time worked. I need to know if this is an acceptable practice. They claim it is but cannot provide any written information to back it up.
Example:
I work from 7:00am to 4:30pm on site. I then work from home from 4:30 pm to 12:30am. This is 9.5hrs per day on site + 8hrs from home minus lunch/breaks etc.
My Employer pays the 9.5hrs on site but only 4hrs from home minus lunch/breaks etc.
any help would be appraciated.

Hours worked is hours worked. File a claim with the state Dept. of Labor for unpaid wages.

Just for curiosity's sake, does the employer say WHY they believe this practice is legal? i.e., NOT paying for all time worked at home?
What work do you do at home?

They say it is something that they have always done. They say that they are audited evey year and if they were doing something wrong the auditor would have told them. I asked if the auditor saw our actual time sheets and or knew labor law or was he just confirming that they were paying the right amount, taxes etc based on what they claimed on payroll sheets. To that I got no answer.
