I work at a bank in Texas and our Saturday hours are overtime for us. We are paid semi-monthly. My question is, is there any law that says how long they have to pay me my overtime? As of right now, my company is a month and a half behind on paying our overtime. :confused:

It's in Section 61 of the Texas Labor Code, referred to as the Texas Payday Law. It provides that, for covered employers (yours is), paydays must be posted, must be at least twice a month for non-exempt employees, and that pay must be delivered to employees by the posted paydays. In other words, overtime wages are due at the same time as are non-overtime wages.

Employees not paid in accordance with this law may file a claim for unpaid wages with Texas Workforce Commission. See: http://www.texasworkforce.org/ui/lablaw/wageclaim.pdf.

It's a long process. You probably want to ask your employer how they view this potential breach of their responsibility.

Awesome - Thank you very much. I will definitely approach the company first. They are a really great company to work for just really small and things like this can fall through the cracks easily so I am sure I won't have a problem at all getting the process updated. I appreciate the help.
