I am looking on advice on how to change jurisdiction from IL to AZ. I have a court order from IL allowing me to move my son to AZ to live with me. (I have sole, physical custody from IL.) We have been here 3 years and my son is now 17 and has not seen his father since 2003. My question is because of all of his father's frivolous petition filing--forcing me to fly to IL to answer his petitions (none of which pertain to custody, support, or visitation), how can I go about getting jurisdiction in AZ to stop this? I feel another one coming on before my son turns 18 and I simply cannot afford to fly to IL again.

Hi,
Since you and the son live in Arizona, you can open a case in Arizona. You can go to the Department of Child Support and ask them to collect your child support for you. Once the Arizona Department of Child Support gets all your information, they will likely open a case if you need changes to child support or if there are arrears issues. Then when your husband files another motion, you can ask the judge in Illinois to transfer the case to Arizona. Ultimately, it is up to the judge but since you and the son are here, there are good grounds to move it to Arizona. If you have more questions you can go to http://www.familyarizonalaw.com
All the Best.
