My employer hit us with a bomb yesterday. They are having a RIF(reduction in force) and they offered a buyout for all involved. If they don't have enough people apply, layoffs will commence starting at the bottom in seniority. If you apply, you cannot rescind your application. I am at the very bottom in seniority and my buy out consists of $2400 basically over three weeks. I am however on light duty due to a workers comp injury. My question is do I have any protection from lay off due to my injury. I may be cleared to return to full duty in about 3 weeks. Thanks.

FMLA is the only law that would protect your job. Being on WC does not. Even if FMLA applied (and we don't have enough information to determine that), if you would be laid off anyway, that would not be a violation of FMLA.
