View Full Version : Questionable reason for termination Pennsylvania

I was recently terminated for an unclear reason. I was told that "a client made a statement that he was told he could get his accounting work done elsewhere cheaper. Therefore, I am terminating you immediately." I was not allowed to answer the allegation nor defend myself. There was never a conversation with any client and myself about the pricing practices within the accounting firm.
The client in question made a statement to the receptionist about looking elsewhere due to increasing amounts. After the client left, she approached me commenting on the conversation. I was aware the pricing differences for the same work different clients. My reply to her was, yeah I think his bill was was pricey and some other accounting office may charge differently.
My question is this.. am I able to apply for UC benefits and be approved?

First off, this was not an illegal/wrongful termination. You can be terminated at any time for any reason except a reason prohibited by law (ie age, race, gender) or unless you have a binding employment contract or CBA to the contrary.

Go ahead & apply for UI benefits - the state will make the decision as to whether you receive them or not.

One other question, what is the time frame for receiving my last paycheck or do I contact the dept of labor to report wages not paid?

Since filing my unemployment claim, a new issue has arisen. I need to know if I need a lawyer or ask unemployment office for advise.

I received today in the mail a letter from my former employer's lawyer a intimidating notice. The former employer is claiming I am contacting and solictating his clients to discontinue services with him. And that legal action will be taken against me and they will sue for all costs and expenses incurred.

I have not had contact with anyone within the firm or his clients. Nor have I badmouthed his firm to anyone but to my husband who is not from that area. He knows nothing about the client basis nor does he want to.

What recourse do I have? Is this retaliation for filing unemployment?

It very well may be retaliation. However, what damages have you suffered because of it?

Emotionally, yes. Finacially, yes. This has now halted my unemployment and now I have to apply for an appeal due to this.

You can't sue for emotional distress. You also didn't say (or I didn't get from your update) that the UI had been reversed. Do you have another appeal?

I was notified last week that due to new information from employer, your claim has been denied. I have sent my statement into the state and as of the deadline, which is tomorrow, the employer has not responded to the state of my appeal. Now today I receive this letter. Sorry I sound like I am talking in circles but this has set my mind into overload.

I applied for unemployment back on the 5th of March. Filed like I should have. No deposit made and no paperwork. Contacted the state on 18th of March and was notified that the claim was denied due to information the employer provided. Appeal paperwork sent out and received on th 23rd of March. Deadline given to get to state is 26th of March.

My paperwork was received today and they stated the employer has not responded.

You got your appeal info in on time, apparently. However, the employer is given some time to respond to that before a hearing/conference is scheduled or the state decides that no conference is necessary and either reverses or confirms the prior decision based on the law only.

Sorry that's not probably what you wanted to hear, but these things do, unfortunately, take time.
