I was fired from my job over the phone on my second day of STD. We had just come back from being laid off for a week. Will I still get my vacation and floater holiday pays? And it is legal for them to do that?

Contrary to popular belief, collecting STD benefits does not provide you with any job protection. Whether you will be paid any vacation or floaters will be up to company policy. Neither is required under either Federal or Ohio law. singlemomnohio 03-05-2009, 06:55 AM They tell me for not letting my ops manager know that I was leaving early on monday for a doctors appointment. But I did tell my lead who then told the manager. I just didn't know if they could fire someone when they were out on STD or any other type of disibility. But then to do it over the phone?! Don't I have to sign a paper or something? cbg 03-05-2009, 07:17 AM Yes, you can be termed while on STD. You cannot be selected for layoff because you have a disability that qualifies for protection under the ADA (not all or even most conditions for which you would take short term disability leave qualify under the ADA), you cannot be selected for layoff because you took FMLA, and you cannot be selected for layoff because you are pregnant. But you can be fired in spite of having a disability; in spite of taking FMLA leave (we don't know if yours is FMLA or not) and you can be fired in spite of being pregnant. If you would have been fired regardless of the disability, pregnancy, or FMLA, then none of those things protect you. There is nothing illegal about doing it over the phone and there is nothing that, by law, you have to sign; whether or not you have to sign anything is up to your employer. Do you have reason to believe that they had a different reason than the one they told you? If so, what is it? singlemomnohio 03-05-2009, 07:40 AM They had cut our hours down to 35 per week, and they were wanting to get rid of someone also. So I guess I was a sitting duck since I was out under a doctors excuse. For about the last 5 weeks, I felt like I had a target on my back, the others were different around me and secretive. It was like they knew what was going to happen. And when the manager would get off the phone with our regional manager, it was like she was pointing out what I did when infact it was her mistake. The paperwork had her initinals on it. And I would fix it and not say anything, but she kept on me more so than the guys. They could do absolutely nothing wrong, and if they did, they got a slap on the wrist. |
