My husband works 11 hour shifts in a factory in Blacklick, OH 4pm to 3am. He gets 2 10 min breaks and a 20 min lunch all of which are unpaid. From everything thing I am reading I understand it that while Ohio and Fed law do not require breaks or lunches if a company does offer breaks under 20 mins that they are to be paid. Am I understanding this right or not? Thanks for the help.
Federal law does have that requirement, yes. Offhand I don't think state law in Ohio addresses it at all, but they can't make Federal law go away.
By any chance is your husband working under a union contract?

No he is not under an union contract. Who can we contact to remidy this situation and will they have to make it retro?
He would report it to the US DOL. I have no idea if they will make it retro or not but I would imagine so.

Thanks for your help. We just didn't want to get anything started if we did not have a leg to stand on!
