I drive a company service van to work and home. Normally, I am not paid for the commute to work which is 30 minutes. When we are on call after hours during weekends and evening, we only get paid 30 minutes for travel time one way. If it takes longer, I have to eat the time. But I am required to follow all company rules while operating their vehicle. Should I be getting paided for the rest of the time while operation a company vehicle? I receive assignments on my cell phone from an answering service. I then have to call the client and make plans to get to their house. I have to map out all the directions before i leave my house. I am an hourly employee and do not receive any commissions from them for any sale that I make. My company does charges a trip charge to the customer for our travel to the clients location. Please help.

Merely driving a company vehicle does not, in and of itself, does not make driving time compensable. The fact that the company charges the customer a call "fee" does not have anything to do with what they must pay you.

However, this regulation might apply but, as you will see, there is no black and white answer in the reg; only that the specific circumstances would have to be reviewed:

Calling the client and finding your directions is compensable time.

What do commissions have to do with this?
