Thank you Labor Law Talk! After 8 months of conversation with my employer they have finally decided to change my exemption status to "salary non-exempt." I finally convinced them, (or their labor attorney did), that my job duties did not fit the exemption criteria. When I first brought up the question they said 1) you are exempt because you are salaried and a manager; then 2) professional exemption even though I hold no degrees or have advanced training in any field; and finally 3) computer related exemption even though I don't meet those criteria either. So now I've completed my first week of non-exempt status with overtime. My company continues though to use titles for exempt/non-exempt positions. Since I am no longer exempt I can no longer be the "manager," even though the duties have not changed. I have now been given the title "computer technician." I should add that I have recovered an e-mail from a fellow manager that specifically orders the HR department to change the title of "manager trainees" to production supervisor I, to avoid paying overtime. Also, when I asked about recovering back wages they acted as if they didn't know anything about that even though they are well versed in the statute of limitations. It's been a week since we've had this discussion. What do you think?
