View Full Version : Ex is filing for pet. to stop child support paymets due to change in income. Florida

My ex and I were awarded 50/50 custody back in 2002. He was ordered to pay $700 per month and has never seen or wanted to see my son. Payment were made on time for the most part during the first 5 years. I moved to California in April of 2007 and continued receiving payments until April of 2008 when payments stopped completely. I am currently in Florida grieving for my Grandmother's passing and I received a court paper that says request for trial in 86 hours after time I receive paper. Since I still live in California, I do not want to start any court proceedings until June when we are moving back to Florida. I do not want to lock myself into a trial because I cannot afford to fly back and forth for the court dates. What can I do to push everything until June when I live in Florida again? Do I go to the trial and request an extension? I do not want to let this issue go because my ex is claiming that he cannot afford to pay any child support from here on because of his income changing, but he is also paying cs for two other children from a previous marriage. Somebody Please Advise...


It also came to my knowledge after reviewing the file from 02 that I was supposed to inform the courts on any address change which I failed to do because my ex has never seen or wanted to see my child.

If i were you I'd get a lawyer in the state he lives in to handle this that way you don't have to spend a lot of money to travel,and if he paid you 700 a month and two othere cs cases then i don't blame him for tring for a reduction,how he was able to afford that and plus, is awe to me.the child support system is like the irs when you owe.and if you had a 50/50 custody thats were the judge may get upset with you living town and all,really find that lawyer soon so this can be approached in a timely manner
