View Full Version : Overtime for over 8 hours for California Employee California

I work in Southern California. I work under 30 hours a week, but I do work over 8 hours. I am scheduled to work a 9 hour shift but usually end up working 10+ hours per day. I only work 2 -3 days a week so my total hours for the workweek are maxing out at 30. Should I be receiving overtime for every hour over 8 hours in a day I work? The payroll manager explained that because I am not a full time employee I am not eligible for overtime over 8 hours.

Your payroll manager is wrong. He would be right in 47 other states but CA is one of the few exceptions where overtime is due over 8 hours in a day regardless of how many hours you work in a week.

File a complaint with the DLSE.

Agreed. No such rule regarding part time employees and daily overtime.
