View Full Version : Haven't gotten paid Arizona

I work for an agency in which I am set up for Direct Deposit. It is supposed to go through on Fridays at 12 am but has not. It is 2:00 and still nothing. I have worked for this agency for 2 yrs and this has never happened. My question is: Is there a law/or anything saying how much time from when the chk was supposed to be deposited to when they have to get the $ in there? Anything like end of business day? Any advice would be great!

As long as it is deposited on pay day, they're legal.

So you are saying that they have until then end of business day or midnight tonight?

Theoretically until midnight. Practically, it's not likely to be deposited after the close of business hours because the banks will be closed as well. But the law only requires that it be paid on the DAY designated as pay day - the law does not specify that it has to be deposited at any particular time of day.

Also, the employer has nothing to say about what time the bank posts funds to accounts. One of my not-fun things with doing payroll was taking phone calls from employees asking why if Joe's bank made funds available early why doesn't Jill's bank?

How the heck would I know? The employer sends the money into the ACH system the correct number of days ahead of time and past that point, whatever happens, happens. Same thing with mailing checks. I never understood why employees thought I had people with cameras following around every check we sent via U.S. mail so I would always know where it was. I (payroll) made certain that we sent out both direct deposit and checks in a timely manner, but once we did, we functionally had a thrown rock with no idea what happens. Over the years I got a pretty good idea which banks released funds early and which ones did not, but other then the employee changing banks, it is not like any of those banks was checking with me to see what time the funds were to be released. Per the ACH rules, the funds are never supposed to be released early, but are always supposed to be released by the end of the banking day. And no, the time is not spelled out the ACH rules, at least it was not the last time I read them.
