Jan. 28 & 29th in athens county, oh a level 3 snow emergency was called by the sheriff. Athens county was also declared an Emergency disaster. My Manager told me not to come in to work. I work in an office of a Financial Institution (non esstential). The company nows says my Mgr had no right to make that call and that I would have to use my sick leave days because I did not go to work. My Mgr was forced to go to work that day on a level 3 snow emergency. Can an employer require employees to drive to work in a level 3 snow emergency and when the County has been declared an Emergency disaster because of ice? Who has the authority here...the county government or the employer?

If your manager told you not to come into work, then you have to follow their orders. You sick time can be charged to these days you didn't come in. It's up to your employer how to use sick days.

That depends on what kind of "authority" you are talking about. Labor law is generally speaking controlled by federal and state DOL. The federal and state DOL have no authority to declare a snow emergency. The county government has no authority over how non-county employees are paid. Federal DOL has no interest in the paid time off balances or snow days. State of Ohio in theory could take an interest in such matters but to my knowledge they have not.

I am fairly sure that your employer has broken no laws based on what you have said.
