I am being told by my store manager and HR department, that because I am not covered under FMLA that the only way for me to take leave is to give my two weeks notice and quit.

This to me does not sound right at all and Im not sure what to do. I know they need to treat pregnancy as any other disability or illness would be treated, but I dont have a way to find out what they have done for people in the past.

What really irks me is that I work for a company whose motto is "we're in the business of helping people" and a lot of what they do is job placement and other programs for disabled people!

If I give my notice will I possibly qualify for unemployment? The state requirement says if you quit it must be for "good cause" and a reason such as disability does fall under "good cause".

I dont know what to do! I have been on my manager about this for months, and I finally got this as my answer yesterday, Im due in just over a month!

Florida does not have any state mandated leave so if you are not eligible for FMLA, the employer is not required to provide you with any leave.

I would not quit; I would make them fire you. But in either case, you will not be able to collect unemployment as long as you are medically unable to work. You should be eligible after you are medically cleared to return to work after the baby is born, as long as you are actively seeking employment.
