I have worked for my employer for the past 1 1/2yrs in a business that we opened in the area. I am the Director/Sales. Until recently my employeers have been wonderful.

I was hired at $350wk =7% commission for 30 hrs weekly. I was to work longer if needed.

On Dec. 22, 2008 they called all employees to discuss 2 new wage options.
All outstanding balances on previous sales would be paid at 7%

#1 - $300wk +3% = $7.50 an hr + 3%
In my case I would make $225 + 3% they also agreed to pay my travel time.(a few of my other offices are 2 hrs away one way.

#2 - 10% straight commission & you would get to work only when you have appointments! (They encourged me to take this because I have a 13 month old baby).

I expressed that I needed to discuss it with my husband and I agreed to email them within the next couple days. I decided to try and negotiate and sent a response that evening asking that I get $300wk +3% for 30hrs. I NEVER recieved a response.

On Jan 16, 2009 I recieved my first check with this new pay (We were on a company wide "Vacation") from Dec 23, 2008 to Jan 5th........no pay of course. Since I had heard nothing I figured a min of $225 + $120 in commission + $345. My check in fact was a gross of $237 (32 hours) but it was broke down like this: $120 commission + $117 draw = $237 So instead of making $, I am basically pay myself to do my job (since I need to pay the draw back. As of 1/30/2009 I will be $561 in debt to the company, even though I have worked all those days. When I contacted my employer regarding this they said this is the way it was for all employees and the draw was to be sure we got a paycheck but we needed to pay it back out of future commissions, no explanation of what happened to the original offer. I have sat and stewed for the last 2 weeks on what to do about this thinking maybe I misunderstood.

Yesterday another employee contacted me because she was very upset (oh yeah we need to do time sheets now even though in a previous email we were told it was a one time thing). The employee was wondering if I knew why we needed to do a time sheet. One thing lead to another and she told me about her wage cut and how she didn't know about the draw ect ect. Pretty much the same conversation I had with my employer regarding wages. She also was unaware of the commission/draw/payback draw senario.


I have actively been looking for a solution since business is very slow. I understand it is slow and I am an expense for my employer right now. I offered to take a voluntary lay off and I would work and not claim unemplyment the week that I work for them, but they told me that was illegal.

I had my resume on Michigan Works looking for an evening job but once they saw it they posted my current position and when I questioned them on it they sent me an email stating that it was now "a race to see who wins" I get a job or they fill the job. When I called them regarding this matter I was told I need to figur out what I want to do....work for them or work somewhere else. I pulled my resume and they removed the posting of my job. I have continued to look for a partime job on my own but am scared to put that a job can call my bosses because I don't know what they will say and I am sure that I will be terminated.

I again today questioned the pay scale and in turn they requested that I now send a list of all the patients I have seen since Jan 5th 2009, and with every payroll from now on. They also expressed that I have had no sales since Dec 22, 2009 and any other employeer would have fired me for non-production. I am the Director were I am and I know that this is how they start weining you out......I seen it happen before to another employee. They made his life a HELL. Everytime he turned around he was getting a write up until they finally fired him which was totally bogus....we had discussed it and they were going to let him go because we were so slow they could not justify the expense of him.

They set my appointments that I sell from. This month I saw 2 people, one was medicaid (I don't accept) and the other guy is in limbo....he was in today for a demo and will let me know on Monday. I have worked my files until the people tell me to stop calling. I have only done maybe 6 checkups all month/ I don't know what to do to produce more sales. I know when they see what I have done for the last month they are going to freak!!! At the rate I am going I will never be able to payback my draw and my employeers are being very rude and will Not discuss anything.

The sad part is that some offices have a support person that does half my job and they make $10-$14 am hour. I along with the other employee I mentioned do everything, granted I am not very busy but I still complete all the same reports ect. I am still a staff person and I am still there every day ready and willing to work. Why shouldn't I (we) get something when I (we) do all the work?

I keep telling myself that I am lucky to have a job in these hard times, but I am not so sure. When I pay a min of $210 bi-weekly for daycare and pay gas for the 16 mile drive each way I am in the hole. On top of that I feel like they are threating my job.


I am so stressed because I don't know what to do, I think it is actually making me sick...are they in the wrong for anything? Michigan unemployment is not help full and I can not afford to gamble and see if I can justify quiting. Oh yeah, regarding unemployement, they only show me as being employed there since 6/2008 & I have worked for them since July 2007.
My husband says I should quit, cause it is all getting a bit fishy.

I am a good employee and give 100% every day. I would love to resolve this with my employeer but they have made that impossible. I am starting to get very bitter and working in Sales, you can not afford that! They are making me HATE a job that I love. (I have been in this field for 8+yrs)

HELP - I need an outsiders opinion!!!!

PS I have made copies EVERY email we have passed dicussing these matters.

I need to correct/clarify a few thing in the above posting!

The original wage was $350 + 7%commision for 30 hrs worked.

I now get pd $222 (weekly draw or commision) whichever is greater. That is not even min wage per hour. It works out to $7.40 per hour, which I am actually paying myself since it will comes out of future commission. This new pay scale is a FAR cry from what we discussed.

I want to clarify that I have made copies of all emails that my employer and I have exchanged regarding this matter. Not this site!

I am not a labor expert by any means but my suggestion is to make them fire you. Don't do anything that means you are not doing your job but just have a bad attitude about it. Then, file for Unemployment.
I am sure people will disagree but you are in a no win situation. And, if you quit, I am 100% sure you will not get unemployment.

rick=tmlonghorns....Moderator suspended my account becasue I disagreed with their advice.
On here you will only find people who provide one sided advice. They will always tell you that the employer is right and that they have done nothing illegal.
As I said, you truly are in a no win situation and if you think you are going to lose your job just do not quit! That is the best advise I can give you because if you quit you get no unemployment.

Rick - it is just plain not true that your account was suspended because you disagreed with me, and if you continue making that statement you are going to have still another account suspended. And I can keep that up as long as you can.
