If my employer missed hours on my payroll check, how long do they have to issue me a manual check? Do I have to wait for the next pay period?

Pattymd 01-29-2009, 09:47 AM Legally, there are a certain number of days following the end of the pay period (the number varies as to whether you are paid monthly/semi-monthly or weekly/biweekly). How many hours are we talking about and have you spoken with the payroll department about a manual check? CAOvertimelawyer 01-30-2009, 05:46 AM Short answer, they should issue it immediately. Mrs. T 01-30-2009, 07:20 AM I have talked to payroll and they have an 8 hour rule, meaning if less than 8 hours it's added to the next check. If it's over 8 hours it's issued as manual check. We are paid bi-weekly. Where can I find the rules to see if they are following the CA guidelines? Also, if it's my fault for not punching in/out does it make a difference as opposed to HR not adding my time in for missed punches? Pattymd 01-30-2009, 08:05 AM The "rule" is one they made up. And no, it doesn't make any difference whose "fault" it is. I'd take it higher up. Mrs. T 01-30-2009, 09:00 AM You mentioned that there are specific rules based on the pay schedule. What are they and where can I find those? I'm trying to help them out, not get them in trouble. Unless in the event of a termination. Is it true? Or is this another made up "law". DAW 02-04-2009, 06:09 PM It is an example of a company policy not based on an actual law. |
