View Full Version : Ca labor laws for a Ga resident

I live in Georgia but work for a Silicon Valley Ca company. I am approaching my 1 year start date and I am on plan from a performance standpoint. Do California or Georgia laws apply to me?

I am 43 years old and just got let go by my new boss that is in his 20's. I am a commissioned salesperson and have been for 10-15yrs. I was told less than three weeks ago how good I am doing from a performance standpoint from my new boss and the VP of sales at this particular company. I have built up a pipeline of new business that is apprx. 5 times my quota. I was told I had no issue to worry about regarding my employment for the next 6 months from my new boss as well as how he was going to help me kill my quota for 2005. I understand that I can be let go/terminated for no reason based on CA law. I found out last Thurs this was the case and that the reasons for my dismissal are completely fabricated by my new boss. These reason's are not even close to the facts. It seems companies in this High Tech Sales space just do not have any regard for the employee anymore. Performance used to guarantee employment from salespeople....

I found out last Friday that my replacement was hired this same week on Thurs. The replacement is a lot younger than me and a possible past coworker to my new boss. He obviously wants to build his own sales team as several of us have had this issue the last few weeks. We are all over 40 and hired from the previous sales management team that is replaced.
How would I go about to discover/investigate a possible age discrimination issue with this company? How could this be proven and how difficult is it to prove?

Are there any attorneys out there that would take this on contengency? How would I locate one of these attorneys?

California labor laws don't cover you because you are living and working in Georgia. However, protection against age discrimination can be found in federal law. You can read more about it at: www.eeoc.gov (http://www.eeoc.gov). Your employer must have at least 20 employees to be covered by the federal law. Georgia's law prohibiting age discrimination has the same requirement.

If you feel that you are a victim of age discrimination and your employer is of the minimum size, you can file a complaint with the eeoc. You don't need an attorney to file a complaint. However, if you are looking for an attorney's assistance, my suggestion is that you go through

As far as attorneys who would take your case on contingency is concerrned, my suggestion is that you go through your local yellow pages. I rather doubt that an attorney will take this case on a contingency basis until you have gone through the eeoc complaint process and the eeoc makes a determination that there is cause to believe that discrimination exists.
