My company recently retructured our sales force to break down into smaller regions. For the last 3 1/2 years, I have been filling the position as sales manager and have increased sales every year since I took over. I have never received a bad performance review. Everything said about me was nothing but good things. The company decided to restructure the force into smaller regions and made everyone apply and interview for these new regional positions. For whatever reason I did not get selected for the new position, and was beaten out by a guy with no management experience. I have over 25 years of management experience, the last 3 1/2 being the sales manager. My question is this, can the company reduce my salary if I was successful at what I did for the last 3 1/2 years, but did not get selected? I have always been counciled that I was doing a great job. Also, I am 3 months over due on my yearly performance review. I was told they were going to hold off because of the restructuring. Should I demand my performance review at this point, and also should I receive a raise for the last year? The standard raise for an employee is 5%. They have no data to back up a bad performance review. Any feedback would be appreciated.

There is no legal requirement that you EVER receive a performance review, and the only time raises are required by law is if minimum wage is raised by the appropriate legislative body and you are earning less than the new minimum.
