There is 2 other staff members that were not affected by this, However one of the salaray employees (supervisor) sneaked her spouse to the health insurance plan, and she is making the employer pay for it. The employer only pays the employee health benefit, and we should pay full cost for any dependants we wish to enroll. The adding of her husband insurance is costing my employer $6000 a year, which equals the saving my employer is getting for cutting my hours. Supervisor claims that was part of her contract, five years ago, which contract doesn't state anything about paying for family, plus she is barely doing it, five years later. What can I do besides talking to the boss? She brainwashed the boss, and boss didn't even ask to see contract letter, he just believed what she said.... Is it legal that they cut my hours so that she can wash off additional expense for her husband;s insurance?
You have two unrelated issues.
Is it legal for them to cut your hours? Yes, it is, unless you have a bona fide and legally binding contract or CBA that specifically says otherwise.
The issue of the supervisor's husband is not a legal matter at all. It is a contract issue and quite frankly, it is none of your affair. They didn't cut your hours for the purpose of paying for her husband's insurance.

She needed to somehow make up the difference on the health insurance somehow, otherwise the total cost for the office budget was going to be really high, and Board of Directors was going to notice it by looking in detail at every item. And so by cutting my hours, it is the same amount as they are paying for the health insurance. There is a deficit on our annual budget, and so they were trying to cut expenses, and so instead for Board of Directors looking at every single item, and finding out the huge increase in health insurance item comared from last year, she submitted a letter to them suggesting to cut my hours, and "save them" $6000 a year, and looking to them, that she was so concerned in saving the office $$$... Her contract or policies and procedures doesn't state anything about covering her family on the insurance, only the employee.
If the board of directors is willing to cover her husband on the insurance, that's that.
west2009 01-22-2009, 08:28 AM Nop, Board of Directors is not aware that they're paying for her husband's insurance. That's the reason she suggested to cut my hours, so that they would not figure out the huge increase in health insurance.
Then I suggest you take it up with them. This is an internal issue, not a legal one. I'm sure they would be very interested to know what she's doing, but it's not violating any laws per se. It might or might not be a violation of the insurance policy (probably not, as who pays for what is rarely part of the contract) but it may very well be a violation of company policy.
west2009 01-22-2009, 08:36 AM Then, if they do plan to cover her husband's insurance, wouldn't I have more right to it since I am the employee? I am not getting any health insurance thru them... I made the mistake of being the good samaritan here, and gave up my health insurance thru them for the purpose of insuring another employee that needed the insurance. Company claimed for years, they didn't have the money to cover him, and reduced his hours as to not pay him insurance, he bacame really sick, and so the reason I gave up mine for him.
That's again something you'll have to discuss with the board of directors.
