Hi,

I'm planning on giving my two weeks notice on Jan. 26th. I have Restricted Stock Units(RSU), of a significant value, that vest on Feb 5th that are within the two weeks notice. My last day, technically, would be Feb 6th.

My concern is that the company may come and pay me the two weeks, but tell me my last day is prior to Feb 5th. Am I entitled to my the RSU's if they do this?

You would be much safer waiting till Feb 6 to give your notice.

Yes, I understand, however my new employer wants me to start on 2/9. I want to give some notice, as a courtesy.

Any suggestions?

Try explaining it to the new employer. They might let you slide it 2 weeks under the circumstances.

Or, you could decide to not give any notice period. Not that I'm necessarily recommending that, but there's nothing in the law that requires you to do so.
