I currently work part time in an office with 6 people including myself. I've been with the company for about a year and a half. The headquarters for my company is based in MA. I am pregnant and due in April. My question is..am I eligible for FMLA? I'm confused because the actual company employs over 1000 people but since my office is small and located in NJ I wasn't sure if I could take the FMLA. Thanks!

Federal FMLA requires at least 50 employees within a 75-mile radius of your job site.

But the good news is you will be able to recieve the new Family Leave Insurance benefits after 7/1/09.

You will also qualify for MA Maternity Leave which is 8 weeks of unpaid, job protected leave.

Thanks for the replies. That makes me feel a little bit better. HR is still trying to figure out NJ laws for maternity leave. Are the 8 weeks unpaid MA version of FMLA? How is it that I am eligible for that? Also, for the Family Leave Insurance as of 7/1, can I take that right away and is that paid time off? Thanks again. I appreciate the feedback.

I'm sorry, I misread your first post. I read it as YOU were in MA and the rest of your company was in NJ. Forget what I said.

You can take the leave anytime after 7/1 but it must be during the first 12 months after the childs birth.

Read the link I gave you carefully as it explains everything. The process needs to be started and approved by 30 days in advance (I'm almost positive about that but check the site.)

This is only a mechanism to get you paid while you are baby bonding and does not afford job protection. It will pay roughly 2/3 of your salary up to a max. of 546/week.

You started paying in to this fund on 1/1.
