View Full Version : Withholding paycheck for debt owed? Virginia

Hey everyone i really need some help here please, this is my first post....
where to start....
I was a restaurant manager in Chicago, My director of operations asked me to transfer to Virginia for a promotion so I did. Before I left Chicago I was given a LOAN of 1,500 to help find an apartment in Virginia. There was never any contract signed as far as repayment of the loan. Three months after being in Virginia I decided to leave the company. My last check (70hours of work) was withheld because I owed them for this loan? My question is can the do this? The verbal agreement was $50 taken from every paycheck and there was nothing ever said about if I left the company. Are they allowed to hold my check or should i pursue this further? I should also note, I started in Chicago, Transfered to Virginia, but the corporation is in Texas so which labor laws apply?

The laws apply in the state where you worked - Va.

If they gave you a loan, they are entitled to repayment. However, they are not allowed to hold your final paycheck & you can put in a claim/complaint with the Va. DOL. However; if you pursue for your wages & they do end up giving you your final check, they most likely will turn around & sue you in small claims court for repayment of the loan.
