I have just found that I am pregnant and am in the midst of final interviews for a position that I want very badly. What are the laws regarding hiring someone who is previously pregnant? If they decide to hire me on, when do I need to tell them? Am I still able to take the FMLA 3 months if I need to even though I have just started?
Thank you for any response. I look forward to learning more.
There are no laws dictating when you must tell them you are pregnant. However, they are prohibited from refusing to hire you BECAUSE you are pregnant. You will not be eligible for FMLA because one of the eligibilty criteria is that you have worked for the employer for 12 months; you will not have met that requirement. You will be limited to whatever leave they would approve for a similarly situated employee who had a non-maternity medical condition, whether that is two weeks, six weeks, twelve weeks, or six months (or any other time frame). They cannot offer you less leave than would be available to another employee who did not qualify for FMLA and who had pneumonia or a broken leg, but you likewise are not entitled to any more time than that hypothetical employee would get.
