Your specific disability policy (which I cannot read from here) may make that distinction - MA law does not. But before I go into the specifics of how much leave you are due, because it can be quite complicated to explain how the MA maternity leave policy fits into FMLA, please answer the following questions: 1.) How long have you worked for this employer? 2.) How many employees does this employer have total? At your location? 3.) In the 12 months immediately preceding the start of your maternity leave, will you have worked a minimum of 1,250 hours? 4.) At the time you go out on maternity leave, how much time if any will you have missed for maternity related reasons (morning sickness, pre-natal visits, etc.)? 5.) Are you having a single birth or by any chance are you having twins or multiple births? (In MA, that makes a difference.) |
