View Full Version : Pregnant and laid off Michigan

I am currently pregnant and I got laid off. I told my employer of the pregnancy when i found out. They did tell the managers in november that there may be people who get laid off. But the said they didn't know what locations and who would be laid off.
When I was laid off my general manager said "who knows after the baby comes we may have a postition for you" I am not certain but that seems to be discrimination to me. Also they offered me an hourly position at another location. Can I still Collect unemployment benifiets since they did offer me a hourly postion? The pay wouldn't be close to what I was making and I would rather not take it because my roomate works at that location.
Any help would be greatly appriated.

Refusing work usually results in UI benefits being denied.

Being pregnant does not protect you from being laid off. It only protects you from being laid off BECAUSE you are pregnant. The fact that you were offered another position is going to make it very difficult for you to claim that you were selected for layoff BECAUSE of your pregnancy.

Turning down available work is a really good way of getting UI denied. It is possible, if the pay reduction is enough, that the state *might* accept that. However, most states will not pay benefits to someone who quit because of a pay reduction or who turned down a transfer for that reason, given that SOME income is better than NO income. In many if not most states, if you quit or turn down a job because of a pay reduction, you cannot get benefits but if you accept a job with a pay reduction, you can get partial benefits to make up the difference.

I'm not saying don't apply; I think everyone should always apply for benefit if there is even a remote chance of getting them. I'm saying don't hold your breath expecting to get them.

My issue then is my room mate made it clear that she would rather not work with me. I have told the "higher-ups" that in the past too. is this ok?

I don't know what you mean by, is this okay. There is no law that addresses whether roommates may or may not work at the same location. That is 100% up to your employer. If they say it's not a problem, then the fact that neither of you wants to work at the same location is irrelevant.

And if you turn down the job because you don't want to work at your roommate's location, or because he/she doesn't want you there, you can kiss your unemployment benefits goodbye. There's a VERY slight chance that you might get them based on the pay cut; there is NO chance that you will get them if you turn the job down because you/your roommate don't want to work at the same location.
