View Full Version : Texas 16 yr old being over worked, under paid?

I am confused with the child labor laws in Texas. After doing research I found little information. My son worked 12 hours, actually 13 with 2 thirty minute breaks today. Is that legal? 12 hours? What about the pay rate, can they really work him like a dog and just pay 12 hours of minimum wage? He enjoys the work/pay, but if they are not following labor laws it is my job as mom to step in. Anyone please help!

While there are a few exceptions (such as exceptions for agriculture and family businesses), it is illegal to employ a child younger than 14. Persons 14 - 15 years old may not work more than 8 hours in a day or 48 hours in a week. There are also restrictions from working at night, with the hour dependent upon whether school is in session or not.

Persons over the age of 15 are not restricted in the number of hours that may be worked.

That aside, Texas does not require overtime for hours worked less than 40 in a week.
