View Full Version : Pay rate changes....smelling kinda fishy Pennsylvania

ok so heres the story short n sweet
I work for a very popular pizza place and have for the last 5 years. My position there is an hourly shift leader position.

We were a coorporate store untill a few weeks ago when we were sold to a franchise.

i recieved my first paycheck from the franchise on the 10th and my rate had changed from 9.5 to 7.74

there was also another shift leader who had his rate lowered as well

i broght this to the attention of my boss and he called his director of opperations and the DO told him that a check for the difference would be there in 3-5days

So i expected to get a check by friday the 19th but of course i didnt

i waited through the weekend and i had my boss call his DO again on monday the 22nd. The DO told us that i should stop worrying about the check and that it would be in with my next paycheck that i would get on the 26th

Now i might just be over reacting becuae of the fact that i needed that extra $ 200 ( the money that i am owed) to by holiday gifts but this jsut doesnt seam right to me

Also when i had my boss ask his DO why my rate had changed he told us that it was a computer glich and that all shift leaders had to be able to clock in as a shift leader or a driver. I accepted that at first beacuse i knew that shift runners had to be able to run a delivery if need be. BUT when me and my boss looked in the computer the only other shift runner in the computer as a shift leader and a driver was the other shift leader that had his pay rate messed up

This doesnt sit well with me bacuse i never clocked in as a driver so i assume that someone would have to go in and manually change my hours from shift leader to driver. i assume this because my pay rate as a shift runner in the computer was correct at 9.5 and the driver rate was 7.74...

yet on my paystud it says shift runner....(XX hours) then 7.74

I guess what i want to know is this
1. Is there any type of illegal n e thing going on here

2. is it possible that i stumbled upon something much deeper?? i only ask this because its the first paycheck with a franchise and the last of the period. maybe changeing a few empoyees pay to keep there labor for the period down, then by the time the empoyee realizes the rate adjustment would come from the first period of 09

HMMMMMM?? please any feedback will be greatly appreciated

It's against the law to lower pay for hours already worked. It is not against the law to lower pay on a going-forward basis as long as it doesn't bring the employee below the minimum wage. No one here can know whether this was an honest mistake or not. Your recourse, if the situation is not resolved, is to report the employer to the state deparment of labor.
