What are the rules for holiday pay? Are there exact hours? Is it just for that day or is it the dya before also, like Christmas eve, New Years Eve? Please help!!!

Please help!!! cbg 12-22-2008, 09:30 AM It's unclear if you are asking about being paid a premium for working on a holiday, or if you are asking about being paid for holidays off, so I will answer both. In MA, RI and possibly Connecticut (the state website is unclear), SOME employees who work on SOME holidays must be paid time and a half. In all other states, the law does not require premium pay in any amount. If you work on a holiday, the day before a holiday, the day after a holiday, first shift, second shift, third shift, whatever, the law only requires that you be paid the same as any other day. Working on Christmas or Thanksgiving or July 4 is no different under the FLSA than working on March 13 or September 24. No law in any state requires any private employer to provide any paid holidays at all. Exempt employees, who can only have their pay docked in very limited situations, must be paid for office closings, including holidays, unless they have done no work at all in the entire workweek. But non-exempt employees, who have no legal expectations of being paid when they do not work, are subject to the employee's policies with regards to holiday pay. Betty3 12-22-2008, 06:56 PM Just to add: The employer cannot dock exempt employees pay for less than a full workweek but they can require that exempt employees use PTO for days off of less than a week. If they don't have enough PTO, their pay may not be docked unless they do not perform any services in the workweek. |
