Hello, I have a question regarding my lease and late fees. Last year I signed a renewal lease that included a rent increase. Several months ago, I received a notice with the new rent amount but didn’t return or sign anything. I have been paying the amount listed. I am thinking of moving out for several reasons including dilapidated appliances, the steam heater and new noisy upstairs neighbors. I have put up with the crap for several years and figure its time to move on.
Am I in a valid one year lease, it appears to be monthly tenancy. I don’t think I am because I was just notified of the rent increase. Also, my landlord claims I owe him late fees from 6+ months ago but never made any effort to collect the fees. He continues to cash the rent checks. Am I liable for the late fees? Can he deduct them from my security deposit if I decide to move out?
