Hello Group,
As a company we have overpaid on commissions for our entire sales team for 1 and 1/2 years.
We had a software program that was supposed to be paying the salesmen 10% commission of the profit on a monthly basis and it posted 15% each month instead. Because of this, we have found that we have overpaid our sales team thousands of dollars. It may range from $5K to $20K depending on the salesman.
We understand ours is a big mistake but we feel our salesmen owe us that money.
They feel that since it was our mistake, we should take the hit and just fix the software program and start fresh.
We are willing to have them pay it back in installments.
What is the law on this? Can we make them pay it back?
What is the right thing to do?
