A similar situation in which my wife is a public school teacher. She works part-time, but due to maternity leaves & other stuff, she has worked full-time on & off just before and just afte maternity leave.

The HR department has claimed that two years ago, she was getting an MBA payrate and now expects her to payback the extra $10,000 dollars. As a side note in the process, the HR dept has screwed up her paycheck when she was temporarily working full-time (paying her part time when should have been full time).

How far back can the public school system go and the what are the labor laws for overpayment to a school teacher?

Most public school teachers are unionized. Has she spoken to her union representative about this?

She has, but the union president has been very unhelpful. He just keeps saying it is her responsibility to check her pay stub. Which is true, but again, not very helpful.

If the underpayments have been corrected, then this is something she'll have to work out internally, if the union is not going to offer any assistance.

Does she agree with the amount they state she was overpaid? Are they willing to work out a repayment agreement?
