I've read through these forums for a while and think I know the answer, but I thought I'd post anyway to make sure I'm not missing something.

My husband just requested time off for Christmas and took the first four days as personal days since they do not carry over. His boss asked him to take them as vacation days and would not say why. This sounds like they will be laying him off as I believe they would be required to pay unused vacation but not personal days. I'm assuming they can force him to take the leave as vacation. Is this correct?

Yes, they can require the use of vacation time.

Texas does not require the payout of earned unused vacation at termination for private sector employees unless it is owed under a company policy or employment agreement/contract.
