I recently just left a job. I put in more than my two weeks and happened to get food poisoning and missed one shift. I completed the rest of my shifts prior to that. They will not pay me my bonus because they are saying I didn't complete my entire two week notice. Is that legal?

Also when I worked there I carried a pager and had to answer pages from 5:45am to midnight and was not paid for the time I spent on the phone for the company.

I also was required to go to meetings over a half an hour away for my home store and was not paid mileage.

Any ideas on if this was illegal?

What was your job and what duties did you perform?

If the bonus was discretionary, yes they could refuse to pay it out for missing a day in your notice period, regardless of the reason.

How often were you answering pages and how long did this take you?

Mileage is not required.

Whether or not you must be paid the bonus in this (or any) situation depends on the terms of the bonus agreement. The law does not directly address bonuses.

They are not required to pay you for time you were on call but not working. You *probably* have to be paid for time you were on the phone but it's going to depend, to a certain extent, on the length of the call. If you spend half an hour on the phone clearing up a problem, you have to be paid for that; if someone calls you to ask where you left the Johnson folder and you're off the phone in 45 seconds, that's de minimus time that does not have to be paid for. This assumes that you are a non-exempt employee; if you were an exempt employee, you do not have to be paid additional for any on-call work.

Michigan is not one of the two states that requires reimbursement for mileage.

I was a store manager at a tanning salon. I made $8.25 an hour.

Some days I would have 15 pages a day others I would have 3. It varies. Some times I could fix the problem in 2 mins and some times it to half an hour.
