Hello,

I was renting month to month with no lease signed. When I gave my 30 Day Notice, the landlord told me that it had to be 30 days prior to when my rent was due. However since I notified the landload on the 8th (instead of the 1st) they are claiming I owe them an additional months rent. Meaning that since I didn't notify them on the 1st, I now have to pay this months AND next months rent.

I have NEVER heard of anything like this before and I've been renting for 10 years. I always understood the policy as 30 Days from when you inform the Landlord. Is what they are saying true? Am I bound to pay them this amount?

§ 55-248.37. Periodic tenancy; holdover remedies.

A. The landlord or the tenant may terminate a week-to-week tenancy by serving a written notice on the other at least seven days prior to the next rent due date. The landlord or the tenant may terminate a month-to-month tenancy by serving a written notice on the other at least 30 days prior to the next rent due date.
