Can a tenant make after hour, unapproved repairs in the rafter portion of a duplex, thus giving him access to the other half of the rental, and making the other tenants feel unsafe at home?(Crawl space access only) This guy is crawling around in the ceiling above both of our duplexs anywhere from 7pm to 12am. I mean this is really odd behavior, my fiance is afraid to be in the house by herself. If my landlord takes no action, can I take legal action against him/her?

No he cannot make such changes to dwelling you have grounds to remove tenant.
Thanks for the info, but I'm actually the tenant who lives in the other half of the duplex, so I'm curious about what rights I have. Because a confrontation is not far off.

Unless the other tenant has ok to alter building the Landlord has grounds for action. If you personally can prove your privacy violated contact Police

Have you looked around to see why he would be up there?
Have you ASKED him why he would be up there?
I would look first... and look for cameras...
Then I would confront him and then talk to the landlord.
He doesn't have permission from the landlord, he claims to be fixing the noise problem in the ceiling. Though he has never complained to us or the landlord about noise. He has hung sheet rock and silver, reflective material up there, and leaves extension cord work lights strung throughout the insulation.(FIRE HAZARD) I don't know if it's violated of our privacy, but it's a little creepy to be watching a Kings game and hear your neighbor crawling around above your head. His hammering noises have been going on for awhile, I only recently discovered that he was in the rafters. Thanks too all, and Happy Turkey Day!

It sounds like he is growing pot. I would take a look and perhaps mention your suspicion to the landlord. He is the one facing forfeiture of his property if he knows about a possible drug operation on his property and does nothing.
