View Full Version : Is my lease valid?

I live in Washington state and entered into a 1 year lease in july of 09. my father is on the lease with me due to some credit issues but he does not live at the residence. Whe I signed the lease the property was still under construction and we set a move in date. About a week before my scheduled move in the property manager called me to inform me that the place would not be finished on time. At that time I made the decision to be moved into a different unit within the same facility under the same management. The new unit was larger in size and the lease payment was more. We moved in without signing a lease agreement on the new place and a couple of months after we moved in the property manager called me and said that they had a new lease to sign with the correct unit number on it. I told my father (who lives three hours away) that he would have to come up here and sign a new lease. He said that he will not sign on the more expensive unit and that since he was not notified of the change that he was not responsable for the lease. They did not even call him to get approval on the higher payment. They just let me make the decision. My question is. Am I in a lease or would it be considered month to month? The original unit that we did sign a lease on has already been leased out to someone else. Does that void my original contract? In the first lease we signed there were some pretty stiff penalties for breaking the lease early. We would like to move into a different place and I am fairly sure that I can get out of the place we are in with just the standard 30 day notice and would be entitled to a refund of my security deposit but I just want to make sure that they can't hold me or my father responsible for the terms of the originall contract.

Since the lease doesn't start until next July, I don't know.

This would depend on the wording of any paperwork you did sign.

There is a provision in the law that a contract becomes void if it becomes impossible to perform. An example of this is a contract to lease a car, which is destroyed by a tornado before the lessee takes possession of it.
