View Full Version : Being sued for breaking Lease Utah

I was in a basement apt. the tenants upstairs had 5 kids. They were so noisy, but it wasn't until the kids starting harrassing my own child that I said anything. The mother of the 5 kids upstairs called my daughter profane names. Still did nothing, then I found out she had ordered her children to physically and verbally abuse my child, she'd also verbally abuse my daughter on her way to the bus stop. I called the school to keep my daughter safe, they had counseling with her and anti-bullying counseling with the 3 children from upstairs...I contacted my landlord and basically she told me I was immature and I had to deal with it on my own. The mother upstairs worked with me and was harrassing me at work too. I moved out of the apt, with all of the documentation of harrassment, I called the police on them 3 times. Now I'm getting sued for the entire lease over 3300.00. I moved in in Aug. Paid half of Sept, and moved out early October. New tenants moved in some time in October. What can I do when I go to court? I don't think I should have to pay this seeing as I was viciously harrassed by the tenants upstairs who had the same landlord. Thank you.

The landlord has a duty to mitigate your damages by renting the apartment as quickly as possible, so you should only be liable to pay the rent until he gets a new tenant.
