kayc67 11-15-2008, 07:00 PM My husband was told he has to work his 40 hours a week plus mandatory OT one day a weekend AND MAJOR HOLIDAYS! If he has vacation days scheduled they will pull them and he has to work that time also. It will possibly be through January. Is this legal? We are fretting as we have vacation scheduled and paid for without refunds!

Pattymd 11-16-2008, 06:38 AM And that's true even if the vacation has already been approved. Will the employer reimburse him for some or all of the lost costs? Have you tried to postpone it?
Horse out of the barn now, but depending on the cost, trip cancellation insurance CAN be worth looking into.

Lejes 12-19-2008, 03:57 AM For me as I have been reading this board more this "what can you do?" attitude seems to be common. First, tell the job to take a flying leap off a bridge and find a new job. But mostly, I think that there seems to be a general lack of actual labor regulation in the US as a whole. It has been very eye opening to see how simple this particular area of expertise must be for some lawyers because there is such a lack of it, most near atrocities businesses might try with their employees (who happen to also be human and not a lesser form than the owners of any company) are perfectly legal with little to no incentive to really even comply with the current few laws there are due to any real lack of a threat of enforcement. In fact, for the most part when someone may come here with a problem it seems it's easy even for the general community to guess, because it's probably "legal".
Why are we so very far behind in America? Because of the "what can you do?" attitude and the allowance for businesses to abuse employees as if they are some form of higher class of people and the employees are their slaves.

These forums are a place to ask general legal questions. They are not intended as a place to complain about how the law ought to read. Patty was explaining to you the function of the boards and your response to her was very much out of line. If you intend to continue posting here I suggest you modify your attitude, which will not be permitted as it stands.
No response from you is required and if there is one, it had better be polite or your posting privileges will be in jeopardy.

Instead, using her exact words: "Lejes, this is not the place for your rants." was what, and how, she said it. That is both insulting and presumptuous. Your alliance and conflict of interest is made very clear here coming to her aid when there was a grievous breach of etiquette made by her part as a point of authority in a public forum.
I think you two had better modify YOUR attitude or laborlawtalk wont be lasting much longer. I am not the only one who seems to have gotten bad treatment from the mods here. You continue to treat people badly, people will no longer want to be here and will find something, or make something, much much better.

That should be #1 then on forum post rules, which seem non-existent.
Further, if you want to make up rules on the fly like that (as I have not seen a TOS or Forum rules stating the above) at the very least have the courtesy to letting people who might not know come to know without insulting them in the process.
That is the bottom line.
Your opinion is noted. Clearly you have not spent much time reading the forums here, however, or you would have noticed that far from being "on the fly", the rule has been noted over and over and over.
