Hi I just got fired from my job for sexual harassment but the thing is I don't really consider it sexual harassment, so I'm asking for some advice.
I went into where I worked (gas station/food place) and was joking around with the guy when I was at the register buying some stuff. In a teasing kind of manner I said "hey you wanna have sex?" and just laughed it off and said I was kidding. That's the only time I ever did it or said anything related to it. Is this really considered sexual harassment?

As far as your "record" you will need to speak with a lawyer about that if you are charged.

First of all, it won't go "on your record". However, your former employer may be able to tell future employees why you were let go. You may wish to send them a letter, saying that you wish to appeal their determination of sexual harassment. Let them know that you agree to drop this matter if they were to change the reason for your termination from, "sexual harassment", to "job elimination".

If they agree to change the reason, you will then become eligible for unemployment and they won't release information about you when you give list that company as a former employer.

Next, what is sexual harassment? The comment you made could constitute sexual harassment. Illegal harassment is in the eye of the victim. It also follows a "reasonable person" rule...what a reasonable person would find offensive. Another factor in determining harassment is that either a pattern of offensive behaviors OR a single incident that is egregious.

It's important to understand that sexually charged topics (or for that matter, about personal items such as religion, etc.) don't belong in the workplace. The reason is that it has become a huge financial risk for the majority of employers. In addition, it hurts the credibility of the offender.

Take this as a lesson learned. It's good that you learned this lesson now while you still have time to recover. Good luck to you in the future.
