My employer is requiring me to work everyday for the past 2 months on an average of 14 hours/day - is there a limit for how many days straight I can be forced to work or how many hours per day? And can I expect time-off or can I be forced to work indefinitely?

I'm an exempt employee on salary. My previous hours were from 7am-4pm, Monday-Friday. It's difficult to work so many hours and still have time for my wife and children. I'd like to know what my rights are in this situation. Thank you in advance for your insight on this matter.

New Mexico is not one of the two states that limits the number of hours an employee can be required to work in a week/pay period; no state limits the number of hours an employee can be required to work in a day.

Although there are a few states that require an employee to have one day off out of every seven, New Mexico does not.

Just an addition to the above, there are a few occupations (ie airline pilot, long haul trucker) + minors where the # of hrs./days straight an employee can be required to work is limited.

As with most situations in New Mexico everything seems to favor the employer. I am just posting my disgust that they can get away with such inconsiderate scheduling. That is why unions are very badly needed across the board in all industries in New Mexico, because their are few laws, broken laws, and workers are kept ignorant of their rights! We need to get laws in New Mexico that protect workers!

If you have a question, ask it. If you only want to rant, this is not the place to do so.

Maybe you don't need a site at all. Just tell them there are no real laws protecting them. Wouldn't that be easier?

That's right, blame everything on the evil employers. Maybe your time would be better spent on improving your skillset if you're so unhappy in retail.

Just for info...my husband is in a union and he has a maximum duty day of 14 hours...and frequently works the full 14 hours.

Corporations are organized and citizens are guaranteed this right as well... My skills are far in excess of what any employer could fairly compensate me for... I didn't mention my company was evil you discovered that fact on your own.

Also I am finding this a very hostile posting environment and anti-worker site. Perhaps our economy is in such horrible shape due to the mistreatment and underpaying of workers. Sorry if worker's rights and human rights cuts into your bonuses and paychecks.

Take your concerns to your elected officials. They can do something about it. Ranting on a message board accomplishes nothing.

The fact is my employer is greedy and is just riding the trend to lay off and cut hours and is in no jeopardy of ever losing any profits. It sees this as a way to further take more for itself.


Complaining here will accomplish nothing. Get out there and work for changes.

All my people seem pretty happy, they all got Christmas bonuses and increases through this "recession", They asked to work 4-10's and got it and we have great benefits and FREE health insurance for them, but you're right I don't care about them at all

The VOLUNTEER members of this board reply based on the law. You asked if there was a law prohibiting those work hours and the LAW does not put a limit on those hours.

The reponders dont always agree with laws or think they are fair. However, they will tell you what the law allows or doesnt allow. If you were hoping that people here would jump up and down and tell you how you are being abused...well sorry, thats not the purpose of this board.

Yep, our employees in the foundry work 9-10-10-10-9-6. One Saturday a month off. And they are union. Just sayin'.
