There are issues for the employer when it comes to depositing withheld taxes, but no, "holding" the check is not illegal. And, if you signed up for direct deposit, you WOULD be paid on Thursdays.

The law on this is that checks must be released on the STATED PAYDAY. Not the day the checks are dated. They are not necessarily the same.

No one is being smart with you. The questions are being asked for a reason. Without the information, which you say you cannot supply, you cannot be given a definite answer.

We DO know the law. What we don't know is when your employers stated payday is. If it's Thursday, then he can't hold them till Friday. If it's Friday, then he need not give them out before Friday, EVEN IF the checks are dated Thursday.

Not true.


Agree with everything cbg said. If you'd just have answered the question, you would have gotten the legal answer.
