Given that you were not eligible for FMLA, the company did not have to hold your job for you at all, let alone give you the schedule that you prefer or work around your husband's schedule. The company's legal obligation to you is to treat you no differently than someone who took a leave of absence for a non-maternity reason.

It sounds like you went to hourly when you came back because you were part time until you could resolve your childcare issues. It's not discriminatory if other part timers are also paid on an hourly basis.

It's also not discriminatory that your co-worker was allowed to change his schedule and you weren't unless the only reason that you weren't is that you were on maternity leave. If the other person was allowed to do so because he'd worked there two years and you've only been there one, that's acceptable. Can you demonstrate that the reason that you were not allowed to change your schedule cannot be explained by some other factor?

I was already changed to hourly when I came back. I worked the new schedule for 2 weeks, and than went back to full time, where they said they were already putting me on hourly.
