What type of business is this? Does it do at least $500K in gross annual revenue OR engage in interstate commerce?

I'm guessing they buy paint and other supplies from out-of-state companies?

In any case, you can always file a claim with the state or federal DOL for failure to pay overtime as required by the FLSA and let the employer see if they can convince TPTB that they aren't subject to the Acvt.
