Hi! Would like to ask advice on my problem with the security deposit.

The apartment is in California. When I received my security deposit refund, I was charged $700 saying that that was the prorated amount for replacing the carpet. However, during the move out inspection (check list), the manager checked that the carpet was in good condition - I have pictures and a copy of the check list. I tried and tried to settle this with them and they said that they needed to replace the carpet because it didn't meet the standards of the next tenant. But I am contesting that in the move out check list, they marked the carpet as in good condition and yet they changed it and charged it prorate on me. Do you think I have a case for this? Likewise, they are charging me $200 for painting the entire 1 bedroom apartment. Is this normal?

It does sound "normal" in that many landlords tend to think they can do anything and get away with it, but it is probably not legal, at least not the way that you explain it.

I did not know much about landlord-tenant law personally, however this summer my friend had a problem that I helped her with (which was also related to the security deposit - essentially not returning it and delaying etc.) I googled a site called www.caltenantlaw.com and printed out information from it. It has a lot of free information. Security deposits are particularly one of the "ten most common" landlord problems.

For the record, I have absolutely zero connection with the guy who made that site. I thanked him once via e-mail because his site design and the way he explains things is real clear, but thats all.
