jesseray26 10-20-2008, 05:20 PM I have been with my company for 2+years. I found out in June that i was Pregant . I was given 20lb restriction and worked with that for over a month. Ask them if there was any problems with my restriction they replied no. Went into work last tuesday and they said they cant accomandate me anymore. As of the following Monday my transfer will be offical, meaning i wouldn't be and the schedule anymore since they hire someone the same day when i got my notcied but they wanted me to work the rest of the week there which i did i informed them that the transfer was way to far. They gave me two options Take an unpaid FMLA which is to soon to take it gives you 12 weeks for them to hold your spot im due with son in 16weeks . Or resign is there anything i can do about it? I cant afford to be out of work.. :mad:

Basically, the law requires that you be treated no differently than anyone who has a non-maternity medical issue. How has the company treated cases where someone who had surgery and came back to work with a lifting restriction?
jesseray26 10-21-2008, 07:06 AM My Boss has a 5 lb restriction, I have asked the big boss why is mine any different. My restriction is 20lbs and temporary hers is for the rest of her life he said how do you know these things i told him she tells us and makes us do her work.. He said that shouldnt be talking to staff about issues like that but never answered my question..
Betty3 10-21-2008, 11:30 PM If you believe you are being discriminated against due to your pregnancy, put in a complaint with the EEOC or with the Mi. Dept. of Civil Rights.
jesseray26 10-22-2008, 03:25 AM I contacted the EEOC already, They said since they offered Other place where i wouldn't have to worry about my restrictions That there is nothing i can do. I really loved my job and the consumers i worked with. IT's not that i don't want to work but i don't want to drive that far away from my home it will cost way to much. I just thought that maybe there was something that i could do besides Quitting or taking an unpaid FMLA.. Is there anyway that i can collect unemployment I never have so i have no clue where to start or if i should even go there.. I did talk to the area supervisor he said that i could still work there but the other staff would have to do the physical work and i do the rest which i talked to my co-workers about they have to no problems with. But my boss never even gave it a try it was only going last like 2 months until maternity leave.. Plus, my co-worker called me last night saying my boss was crying about her back and said her dr said she could go on a 100% Disability but she doesnt want to due her son having health issues.. I just dont understand why this is happening to me and not someone that is a total liabitity to the company.. And has a long term medical issue... Maybe i should just leave alone.. Its just that times are rough with new baby on the way i need my job and money i have called other companies like mine and said that i wouldn't put in enough time for me to even start a new place before i go on maternity leave.. So i am screwed !!! ERGHHHHHHH:(

If you would have to drive quite a distance further, you might be able to get UI as long as you are able to work & looking for work. Some states will allow UI if they believe the distance to the new job would be a 'hardship."
jesseray26 10-22-2008, 10:56 AM It takes me !7 -20 mins to my job and to the other one 40 -45 mins depending on traffic..
Betty3 10-22-2008, 01:49 PM You didn't give me the # of miles further but 20-25 minutes longer would probably not qualify as a hardship. You can call & get an opinion from the unemployment folks.

If they'll give you one. :( I would also not find that 20-25 additional minutes would be such a hardship as to refuse the reassignment.

jesseray26 10-24-2008, 07:07 AM Its about 20 miles to my work and 42 miles to the other site and 75 miles from my hospital where i will be delivering my son... so it took so long to reply back..

Or if what you are saying is that it is 20 miles to your work & an add'l. 42 miles to the other site, I still doubt that would be considered a "hardship" though it would be up to the state to make that decision. (20-25 minutes more isn't really that much)
jesseray26 10-24-2008, 03:54 PM No, It's just 42 miles from house.. Just having transportation there and back is what is hard with DH working and going to college. We are down to one car i have been relying on my inlaws for rides since it's not that far. But that its 42 miles away it like two hours there and back for them and i dont want to put that on them.. My boss knew that i was relying on my inlaws till we got enough to get another car. Then she went and did this so who knows i guess im screwed...:(

jesseray26 10-27-2008, 12:57 PM I fully understand that, But i got a certified letter from the other work site stating that i was terminated as of the 23rd for no call and no show which is a lie i called everyday asking for help on what to do or if there was any other closer sites or midnights i told them the situation that i cant drive that far.. Finally i paged the big boss three times in one day so this wouldnt happen he never called me back instead i got this letter what bull****.. :mad: They knew what they were doing they didnt want to deal with my 6 weeks maternity leave which i didnt have to take till Jan, so they screwed to where i have nothing and now i have this on my work record 2+years for what??????:mad::mad::mad:

Since you didn't show up & it seems as if you weren't going to in the future due to the distance you would have to drive, they apparently terminated your employment. They didn't have to offer you something else in the way of employment.
It seems per your one post that the EEOC said they couldn't do anything (no discrimination) since you were offered a job at a site where you wouldn't have to worry about your restriction.
Since you ened up getting terminated, go ahead & apply for unemployment ins. & see what happens.

I will try the unemployment i just didn't want to go that route i have never had too.. I have tried to apply everywhere no one will hire me since now i am 6 months preggo , One good thing came out of it i will be able to spend a lot of time with son he is going to be five he likes that his mama is home.. I believe everything happens for a reason just not sure what this one was for lol!! Well thanks again for all your input in the matter!!! :)
