I had a new tenant move in and within 14 days, she had been late with the rent and had not paid the pet deposit that was clearly in the lease. I gave her a two month eviction letter on 15th September. I have since advertised the property as being available from 16th November. I have also used the tenants half of their 1 month deposit by agreement, so when she moved out, nothing would be owed. She has told me today that she will be moving on 23rd october. do I not have any claim to the rest of the money in the deposit and the rent that has been paid for October, or do I need to refund her back from 24th october to 15th November?
