Hi, I am a waitress and get paid $2.83 and hour. My question is about vacation pay. What is my employer legally supposed to pay me for vacation pay....he claims that he only has to pay me my normal wage of $2.83 and hour. Is this correct? Thank you.

Legally he does not have to have vacation pay at all, however once established the terms of the vacation pay agreement must be followed. If the employer discontinues the vacation policy he must pay out the terms of past performance agreed upon at hire.

Since vacation pay isn't required by law at all, the employer can pay it out at less than MW, to my knowledge, since MW applies only to hours actually worked.

Not the way I would do it but, as far as I can tell, not illegal.
